3.3. During the reservation, the Client is obliged to provide the following information:
- Stay dates (check-in and check-out dates);
- Selected apartment;
- Contact details (name, surname, phone number, address, email address);
- Number of people in the apartment, provided that it does not exceed the allowable number of people indicated in the offer;
- Planned arrival time;
3.4. The confirmation of the reservation by Łucja Rogowska occurs by sending an email to the address provided by the Client during the reservation process, with information confirming the reservation, summarizing the offer, and specifying the total price of the service.
Reservation Fee
4.1. The Client making the reservation is obliged to pay the reservation fee in the amount of the total price of the service indicated by Łucja Rogowska through the payment system available on the website http://www.cosycracow.pl.
Change / Cancellation of Reservation
5.1. The change of reservation is possible only up to 14 days before the planned date of commencement of stay in the apartment, provided that the apartment in another term chosen by the Client has not already been reserved. If the price of the service in the new term is higher than the previous one, the Client is obliged to cover the difference in the price of the service. If the price of the service in the new term is lower than the previous one, Łucja Rogowska will refund the difference in the price of the service within 14 days. The change of reservation is possible up to 7 days before the date of commencement of stay in the apartment.
5.2. The cancellation of the reservation by the Client is possible up to 14 days before the planned date of commencement of stay in the apartment. In this case, the reservation fee paid by the Client, reduced by the fee charged by the payment operator, will be refunded within 7 working days to the indicated bank account number. If the reservation is canceled after the indicated date, the reservation fee will not be refunded.
5.3. Apart from the situation indicated in point 5.2 above, the reservation may be canceled by the Client if, for reasons beyond the Client's control, it is not possible to issue the apartment to the Client on the date resulting from the reservation in a condition consistent with its purpose - such as a failure in the apartment, an error in the reservation system, or the withdrawal of the apartment from the offer. In this case, the Client will be offered an apartment of comparable standard or the possibility of free cancellation of the reservation.
5.4. If there are unforeseen circumstances in the apartment reserved by the Client, the effects of which cannot be removed, Łucja Rogowska will propose a substitute apartment of similar standard to the Client. In this case, the Client has the right to cancel the reservation with an obligation to refund all payments made by the Client to the indicated bank account.
Check-in and Check-out
6.1. The hotel day begins at 15:00 on the day of commencement of stay according to the reservation (check-in) and ends at 10:00 on the day of completion of stay according to the reservation (check-out).
6.2. Check-in is self-service based on the instructions sent on the day of arrival to the email address provided during the reservation.
6.4. Łucja Rogowska reserves the right to charge a deposit of PLN 500 as a security for the stay. The deposit is refunded on the day of departure, in full, unless damage has been caused to the apartment. The deduction of claims by Łucja Rogowska from the deposit does not exclude the pursuit of claims for damages and potential lost revenue, whose value exceeds the collected deposit.
6.5. Łucja Rogowska reserves the right to refuse to issue the apartment and cancel the reservation to persons under the influence of alcohol, intoxicants, behaving aggressively, and posing a direct threat to other persons and property. Łucja Rogowska may refuse to issue the apartment to Clients who seriously violated the Regulations during their previous stay, including also in the case of having unpaid payments.
6.6. Before check-out, Łucja Rogowska reserves the right to inspect the technical condition of the apartment. If damage caused during the Client's stay is found, the Client is obliged to cover the repair costs in full, no later than on the day of check-out.
6.7. Early departure for reasons not attributable to Łucja Rogowska does not entitle the Client to request a refund for unused services.
Client obligations during the stay in the apartment
7.1. The Client undertakes to use the apartment exclusively for tourism or recreational purposes and may not sublet or provide the apartment for free use to any third parties.
7.2. Immediately after check-in, the Client should report any irregularities found in the apartment, otherwise, it may result in charging the Client with the costs of repair of the found damages.
7.3. Quiet hours are from 22:00 to 6:00 in the apartment. In case of non-compliance with generally accepted norms of social coexistence, disturbing the peace of neighbors, Łucja Rogowska reserves the right to immediately terminate the reservation with immediate effect, without the obligation to refund the costs for the unused stay.
7.4. It is prohibited to organize any kind of parties in the apartments. In case of breaking the ban on organizing parties, the landlord reserves the right to immediately terminate the reservation, without the obligation to refund the costs for the unused stay.
7.5. Smoking tobacco, drugs, and e-cigarettes is strictly prohibited in the apartment. In case of non-compliance with the ban, Łucja Rogowska may charge an additional fee of PLN 500, which does not limit the right of Łucja Rogowska to claim compensation on general principles.
7.6. Clients are obliged to properly secure the apartment, which means carefully closing the entrance doors and windows each time they leave the apartment and carefully storing the keys without access to them by third parties. Taking items from the apartment is prohibited. Clients are obliged to take care of the rented apartment including: turning off unnecessary lights, turning off water, and not removing information hung on the apartment doors.
7.7. The Client is obliged to maintain and return the apartment in an unchanged condition except for wear and tear resulting from normal use. On the day of departure, guests of the apartment are obliged to throw away their trash into containers that are located outside the building.
7.8. Łucja Rogowska or another appointed person has the right to enter the apartment to remove a failure or in case of reasonable suspicion that the Client is violating the provisions of the Regulations.
7.9. The Client is obliged to pay special attention to the proper operation of batteries, fittings, and electrical devices. Due to fire protection regulations, the Client may not use any devices powered by electricity, not constituting equipment, except: computer, shaver, hairdryer, phone charger.
7.10. Łucja Rogowska is not responsible for items left in the apartment. The return of found items is possible only at the Client's expense.
7.11. The Client is responsible for the actions and omissions of all guests staying with them in the apartment, as for their own actions and omissions.
Presence of pets
9.1. The presence of pets in Łucja Rogowska apartments is prohibited.
Responsibility
10.1. Łucja Rogowska is not responsible for inconveniences that occurred during the stay related to:
- Construction or finishing works carried out on the property where the apartment is located and around it;
- Interruption of media supply for reasons beyond Łucja Rogowska's control;
- Noise from neighboring properties.
10.2. Łucja Rogowska is not responsible for the loss or damage of the vehicle left by the Client in outdoor parking spaces.
10.4. The Client is obliged to immediately report any damage caused by them during the stay and promptly cover their equivalent. The Client is also fully responsible for damages caused by persons staying with their consent or knowledge in the apartment. If the damage prevents further rental, the Client additionally bears financial responsibility for each day excluded from the rental, at the rate of twice the current price for the apartment.
10.5. In case of contamination of the apartment with vomit, the Client is obliged, at the request of Łucja Rogowska, to cover the costs of cleaning carpets and other contaminated materials - in the amount of PLN 1500.
10.6. Smoking cigarettes, other tobacco products, and drugs in the apartments and staircases is prohibited. Violation of the ban entitles Łucja Rogowska to impose a contractual penalty in the amount of PLN 500.
10.7. In the event of not returning the apartment after the end of the reservation, the Client is obliged to pay PLN 500 for each day after the reservation end date.
10.9. The apartment cannot accommodate more people than stated during the reservation. If the number of people is higher, the Client will be charged an additional fee of PLN 200 for each additional person for each day.
10.10. If the damage exceeds the value of the penalty or additional fee stipulated in these Regulations, Łucja Rogowska is entitled to claim compensation on general principles.
Complaints
11.1. In case of irregularities, the Tenant has the right to file a complaint within 14 days from their occurrence. Complaints should be sent in writing to the email address: lucja.rogowska@gmail.com.
11.2. The complaint will be processed within 30 working days from its receipt. The Client will be promptly notified of its resolution by registered letter or email to the appropriate address provided in the complaint.
11.3. To pursue claims in court, the court competent for the seat of Łucja Rogowska is the District Court in Krakow. The consumer also has the right to ask for help from the Municipal or County Consumer Ombudsman.
